Welcome to OpenPaparazzi. These Terms and Conditions (“Terms”) govern your access to and use of the OpenPaparazzi platform, including all services, features, mobile applications, websites, and tools offered by OpenPaparazzi.

By registering for or using the platform as a Celebrity User, Paparazzi User, or Paparazzi Pro User, you agree to comply with and be legally bound by these Terms.

1. Definitions

For the purpose of these Terms:

• Platform refers to the OpenPaparazzi application and related services.

• Celebrity User refers to a user who allows approved photographers to photograph them through the platform.

• Paparazzi User refers to a casual or non-professional photographer using the platform.

• Paparazzi Pro User refers to a verified professional photographer who has completed enhanced onboarding and verification.

• Session refers to a booked photography interaction between users through the platform.

• Content refers to photographs, messages, reviews, profiles, portfolios, and other materials uploaded or shared through the platform.

2. Eligibility

To use OpenPaparazzi, you must:

• Be at least 18 years old or have legal parental/guardian consent where permitted by local law.

• Provide accurate and truthful registration information.

• Use the platform in compliance with all applicable laws and regulations.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. User Types

OpenPaparazzi currently supports the following user categories:

• Celebrity Users

• Paparazzi Users

• Paparazzi Pro Users

Different onboarding, conduct, and payment rules may apply depending on the user category.

4. Mandatory Onboarding Requirements

4.1 Celebrity Users

Before becoming discoverable on the platform, Celebrity Users must complete:

Email Verification

All Celebrity Users must verify their email address.

Profile Photo Verification

Celebrity Users must upload a clear and recent photograph for identity verification purposes. This image may be visible to approved users on the platform.

4.2 Paparazzi Pro Users

Before becoming visible to Celebrity Users, Paparazzi Pro Users must complete the following onboarding steps:

Government ID Verification

Users must upload a valid government-issued ID, including:

• Passport

• Driver’s License

• National ID Card

The ID:

• Must match the account name.

• Must not be expired.

• May be reviewed annually.

This information is used strictly for verification purposes and is not publicly shared.

Portfolio Submission

Paparazzi Pro Users must upload a minimum of five (5) original photographs demonstrating:

• Various photography styles

• Consistent editing quality

• Authentic work

Stock images and AI-generated photographs are prohibited.

Selfie Match Verification

Users must submit a live selfie for identity matching against their government ID.

Service Information & Pricing Transparency

Users must provide:

• A biography of at least 150 words

• Service details

• Pricing information

• Delivery timelines

• Details regarding editing, retouching, or deliverables

Client Reference or Social Proof

At least one of the following is required:

• Client testimonial

• Professional social media account

• Portfolio website

5. Visibility and User Control

Celebrity Users control their discoverability on the platform and may:

• Toggle visibility on or off at any time

• Accept or reject bookings

• Report or block users

No photos should be taken without user consent and booking confirmation through the platform.

6. Professional Conduct and Community Standards

All users must:

• Treat others respectfully and professionally

• Avoid harassment, intimidation, discrimination, or abusive behaviour

• Respect privacy, boundaries, and personal space

• Communicate honestly and transparently

• Avoid aggressive sales tactics or unsolicited contact

Violations may result in account suspension or permanent removal.

7. Working with Celebrities

Paparazzi Pro Users are expected to:

• Arrive on time and prepared

• Respect agreed session boundaries

• Avoid bringing unapproved guests

• Maintain confidentiality

• Avoid sharing behind-the-scenes content or client names without written consent

Breaches of privacy or trust may result in immediate deactivation.

8. Booking Rules

8.1 Paparazzi Bookings (Non-Professional)

Celebrity Users booking Paparazzi Users acknowledge that:

• Paparazzi Users are non-professional photographers

• Photos are generally unedited

• Sessions are intended to be casual and spontaneous

Minimum Purchase Policy

The following minimum payments apply:

After one hour, additional purchases are optional.

Celebrity Users must review and approve photographs within 20 minutes of the session.

8.2 Paparazzi Pro Bookings

When booking a Paparazzi Pro User:

• Users can view portfolios, pricing, and service information beforehand

• Celebrity Users choose the session time, style, and location

• Paparazzi Pro Users determine their own pricing

Pro sessions may include:

• High-quality photography

• Editing and retouching

• Professional delivery formats

9. Communication Rules

All users must:

• Maintain professional and respectful communication

• Respond to booking enquiries within 24 hours where applicable

• Keep communication within the platform until booking confirmation

• Avoid misleading claims regarding pricing, availability, or deliverables

10. Cancellation Policy

10.1 Paparazzi Pro Cancellation Terms

If a Celebrity User cancels a Pro booking:

10.2 Short-Notice Bookings

For bookings made within one hour of the scheduled start time:

• Celebrity Users may receive a full refund if cancelled within 10 minutes of confirmation

• After 10 minutes, the booking becomes fully non-refundable

11. Safety and Privacy

Users must:

• Meet in safe and public locations whenever possible

• Verify identities if necessary

• Avoid inappropriate or unsafe requests

• Respect all consent boundaries

Users may end a session at any time if they feel uncomfortable or unsafe.

12. Photo Delivery

Paparazzi Users

• Photos are previewed immediately after the session

• Celebrity Users select desired images within 20 minutes

Paparazzi Pro Users

• Both parties should review selected photographs at the end of the session

• Final edited photographs should generally be delivered within 24–48 hours via email unless otherwise agreed

13. Ratings and Reviews

After each session:

• Both parties may leave ratings and reviews

• Reviews contribute to platform trust and visibility

• Repeated negative reviews may trigger account review or suspension

False, abusive, or misleading reviews are prohibited.

14. Payments and Commission

• Paparazzi Pro Users determine their own pricing

• OpenPaparazzi charges a 20% commission fee on Pro sessions

• Payments are released after the Celebrity User confirms receipt of photographs

The platform may withhold payments temporarily during active disputes or investigations.

15. Tax Responsibilities

Users are solely responsible for:

• Income tax

• VAT

• National Insurance contributions

• Any other applicable taxes or reporting obligations

OpenPaparazzi does not provide tax or financial advice and accepts no liability for user tax obligations.

16. Prohibited Conduct

The following conduct is strictly prohibited:

• Misrepresenting identity or qualifications

• Using another person’s account

• Uploading fake portfolios or AI-generated images as original work

• Harassing or stalking individuals

• Photographing individuals without consent

• Failing to deliver paid services without valid reason

• Sharing private client content without permission

• Making false reports or engaging in abusive behaviour

• Using the platform for unlawful or dangerous activities

Violations may result in immediate account termination.

17. Disputes and Reporting

If disputes arise:

• Users should first attempt respectful resolution through platform communication

• Either party may escalate the matter to support

• Users may be required to submit screenshots, chat logs, or supporting evidence

OpenPaparazzi reserves the right to make final decisions regarding disputes and enforcement actions.

18. Customer Support

Support is available through:

• In-app messaging

• Email support

Typical response times:

• General enquiries: within 48 hours

• Urgent safety matters: expedited review within 24 hours where possible

19. Account Suspension and Termination

OpenPaparazzi may suspend or terminate accounts for:

• Violating these Terms

• Unsafe conduct

• Fraudulent behaviour

• Repeated complaints

• Abuse of platform systems

Users may also delete their accounts at any time using the account removal feature within the platform.

20. Intellectual Property and Content Usage

Users retain ownership of their original photographs and content unless otherwise agreed between parties.

By uploading content to the platform, users grant OpenPaparazzi a limited license to:

• Display content within the platform

• Operate platform functionality

• Promote platform services where permission has been granted

Users must not upload content they do not own or have permission to use.

21. Limitation of Liability

OpenPaparazzi acts as a platform connecting users and photographers and is not directly responsible for:

• User conduct

• Quality of photography services

• Session outcomes

• Financial losses arising from user interactions

To the maximum extent permitted by law, OpenPaparazzi disclaims liability for indirect, incidental, or consequential damages arising from platform use.

22. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after updates constitutes acceptance of the revised Terms.

Users are encouraged to review these Terms regularly.

23. Agreement and Acknowledgement

By registering for or using OpenPaparazzi, you confirm that:

• You have read and understood these Terms

• You agree to comply with all platform policies

• You accept legal responsibility for your use of the platform
